1. About these terms

These terms govern your access to and use of Sparkles, including its website, app, profiles, messages, forums, livestreams, and other features (the “Service”).

By creating an account or using the Service, you agree to these terms and our [Privacy Notice] and [Community Guidelines]. If you do not agree, do not use the Service.

 

2. Adults only

The Service is for adults aged 18 or over. You must meet this age requirement wherever you live and complete any age checks we require. You must not create an account or use the Service if you are under 18.

We may suspend or close an account if we reasonably believe its user is under 18 or has misrepresented their age. We may also restrict access while checking age.

 

3. A respectful community

The Service is intended for transgender, cross-dressing, gender-diverse, and supportive adult communities. People may use different words for their identities and experiences. You must treat others with respect and use the names and pronouns they ask you to use.

You must not harass, threaten, intimidate, stalk, blackmail, or target anyone because of their gender identity, gender expression, sex, sexuality, race, disability, religion, or other personal characteristic. You must not share or threaten to share someone’s identity, images, messages, or personal information without their permission (“outing” or doxxing).

 

4. Accounts and security

Provide accurate account information and keep it up to date. Keep your password and login details secure, and tell us promptly at shona@sparklesuk.com if you believe someone has accessed your account without permission.

You are responsible for activity through your account unless it resulted from our failure to take reasonable security measures. Accounts are personal and may not be sold, transferred, or shared.

 

5. Your content and consent

You retain ownership of content you post, subject to the rights you grant below. You are responsible for ensuring that you have the necessary rights and permissions to post it.

You must not upload, stream, send, or otherwise share:

• intimate or sexual images or recordings of someone without their specific, informed, and freely given consent;
• content involving anyone under 18, or content that sexualises or exploits minors;
• secretly recorded intimate content, or content shared in breach of a person’s privacy;
• another person’s private messages, identifying details, or images without their permission, except where the law allows it;
• content that infringes someone else’s copyright, privacy, or other rights.

Consent to one use of an image or recording does not mean consent to other uses. A person may withdraw permission for future use. You must comply with a removal request where required by law or these terms.

 

6. Licence to operate the Service

When you post content, you give Sparklesuk a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, and display that content only as reasonably needed to operate, secure, moderate, and improve the Service. This licence ends when the content is deleted, except where a limited copy must be retained for backups, legal compliance, dispute handling, or safety investigations.

We will not use your intimate content in advertising or license it to others for their own commercial use without your separate permission.

 

7. Prohibited uses

You must not:

• use the Service to commit a crime, exploit or coerce someone, or arrange non-consensual sexual activity;
• impersonate another person or misrepresent your age;
• send spam, scams, malicious software, or unsolicited commercial messages;
• scrape, harvest, or sell member information;
• bypass age checks, access controls, or security features;
• use the Service to threaten or expose someone, including by sharing their legal name, location, transition history, or other sensitive information without permission;
• use bots or automated tools to access the Service without our written permission.

 

8. Moderation and reporting

You can report content or conduct through sparklesuk integrated reporting systems or contact shona@sparklesuk.com. Please include enough information for us to identify the content or account.

We may review, remove, restrict, or disable content or accounts that we reasonably believe breach these terms, our Community Guidelines, or applicable law. Depending on the circumstances, we may issue a warning, limit features, suspend an account, or close it. We may preserve relevant information where reasonably necessary for safety, legal compliance, or a dispute.

We aim to handle reports fairly, but we cannot guarantee that every user or item of content will be reviewed immediately or that all harmful conduct will be detected.

 

9. Blocking and personal safety

You can block or mute other users. Blocking may limit contact through the Service, but it cannot prevent someone from contacting you elsewhere or sharing information they already have. Take care when sharing your location, identity, or contact details, and meet other members only on terms you feel safe with.

 

10. Paid features

Prices, billing periods, renewal terms, and cancellation instructions for paid features will be shown before purchase. You authorise the payment provider to charge the payment method you select.

You can cancel a subscription. Cancellation normally stops future renewals; access continues until the end of the current paid period unless the law or the purchase terms say otherwise. Any statutory cancellation or refund rights that apply to you remain unaffected.

 

11. Privacy

Our Privacy Notice explains what personal information we collect, why we use it, how long we keep it, and your rights. Do not post information about yourself or others that you do not want shared with the audience selected for that content.

Information about gender identity, transition, sexuality, and intimate life can be highly sensitive. We will handle personal information as described in the Privacy Notice and applicable data protection law. These terms do not replace that notice.

 

12. Service availability and changes

We may change, suspend, or discontinue parts of the Service for operational, security, or legal reasons. We will give notice where reasonably practicable if a change materially affects you.

The Service is provided with reasonable care and skill. We do not guarantee uninterrupted access or that user-provided information is accurate, and we are not responsible for users’ conduct outside the Service.

 

13. Suspension and ending your account

You can close your account. We may suspend or terminate access if you materially or repeatedly breach these terms, create a safety or legal risk, or if we are required to do so by law.

When an account ends, your right to use the Service stops. Some content or records may remain temporarily in backups or be retained where needed for legal, safety, or dispute purposes, as explained in the Privacy Notice.

 

14. Changes to these terms

We may update these terms. We will post the updated version and change the effective date. If a change materially affects your rights or obligations, we will provide reasonable notice where practicable. Continued use after the new terms take effect means you accept them; if you do not, close your account.

16. Governing law

These terms are governed by the laws of [England and Wales / Scotland / Northern Ireland / other jurisdiction], except where mandatory consumer-protection laws give you rights under the laws of your country of residence. Courts in [jurisdiction] will handle disputes, subject to any rights you have to bring proceedings elsewhere.
